Privacy Notice for California Residents

Effective Date: August 15, 2025

This Privacy Notice for California Residents (this “Notice) (collectively, Nippon Shokken, “we”, “our” and similar pronouns). Please note the following:

  • California’s “Shine the Light Law” California Civil Code Section 1798.83 permits individual California residents to request certain information regarding our disclosure of certain categories of Personal Information to third parties for those third parties’ direct marketing purposes. To make such a request, please contact us as described below. This request may be made no more than once per calendar year. We reserve the right not to respond to requests submitted other than to the email address below or to the mailing addresses specified at the end of this notice or more frequently than once every calendar year.
  • We adopt this Notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this Notice. This Notice shall be amended from time to time to comply with the law and any changes therein from this date forward.
  • This Notice supplements the information contained in our “Terms and Conditions” which is available at https://www.nipponshokken.com/terms-and-conditions/.
  • This Notice applies solely to California residents who visit or use our Web Site (“Site”), who register for, attend or participate in our events who apply for employment, contractor or similar opportunities with us or who otherwise provide Personal Information to us (such California residents, “consumers” or “you”). Please note that the CCPA provides certain exceptions with respect to the Personal Information of California employees, job applicants, owners, directors, vendors, suppliers and contractors
  • NOTE: if you reside in geographic locations outside of California, laws of your location may apply. If such laws apply, it will be automatically incorporated into this Policy so as to make the Policy compliant. Upon notice from you, we will amend this Policy to comply.

Information We Collect

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“Personal Information”).

In particular, we collected the following categories of Personal Information from consumers within the preceding twelve (12) months, unless you otherwise request and which we are required to provide by law:.

  • Identifiers, such as name, postal address, email or other similar identifiers.
  • Personal Information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), such as name, address, telephone number, or employment.
  • Internet or other similar network activity, such as browsing history, search history or information on a consumer’s interaction with a website, application, or advertisement.
  • Professional or employment-related information, such as current or past job history.

Categories of Sources

We obtain the categories of Personal Information listed above from the following categories of sources

  • Directly from you. For example, from transactions you request or subscriptions, applications, surveys or other forms you complete.
  • Indirectly from you. For example, from observing your actions on our Site.
  • From other sources. For example, information from marketers, data services companies, social media services, commercially available sources and information from our affiliates or business partners. We may combine information that we collect from you with information about you that we obtain from such third parties and information derived from any other subscription, product, or service we provide.

Use of Personal Information for Business or Commercial Purposes

We use and disclose the categories of Personal Information listed above for business or commercial purposes. As further described in our Privacy Policy, these purposes include to operate, manage and maintain our business, to administer and promote events and offerings of ours or others that we think may interest you (including contextual or targeted ads), for vendor and employment management and to otherwise accomplish our business purposes and objectives.

We use the information that we collect for the following purposes:

  • for the purposes for which you provided it;
  • to send you information about your relationship or transactions with us;
  • to process and respond to your inquiries;
  • to perform analytics and research aimed at improving the accuracy, effectiveness, usability, or popularity of the Services;
  • to enforce the legal terms that govern your use of the Services;

How We Share Your Personal Information

We may share your Personal Information as follows:

  • We may share your Personal Information within our subsidiaries and affiliated companies.
  • We may share your Personal Information with service providers that we engage to provide services to us to support our business operations. For example, we use service providers to send electronic mail and mobile messages and conduct analyses that enable us to improve our products, services, websites and store experiences. We also use service providers for research, digital marketing, fulfilling orders, streaming videos, managing payments and responding to inquiries. Except as permitted by applicable law, we don’t allow service providers to retain, use, disclose or otherwise process the Personal Information for their own purposes. This restriction includes not permitting them to send you SMS messages for their own purposes.
  • We do not share with or make available Personal Information to others.
  • Where we have the legal right, we may share or otherwise make your Personal Information available to third parties such as payment providers and marketing providers. When we disclose information in this context, we make sure that we comply with applicable legal requirements, which may include providing opt-out or other rights with respect to the shared data. We require that the recipients of this data protect such data, obey use restrictions, and comply with all applicable laws.
  • Sometimes we may offer you a co-branded product, service, or other promotion in cooperation with another business, such as our co-branded credit card. When we disclose your Personal Information to our co-branding partner in this context, we prohibit them from using the information provided for purposes outside of the co-branded offering. If you choose to take advantage of a co-branded offer, the information that you provide directly to our co-branding partner will be subject to their privacy notice and practices.
  • We may share your Personal Information where we believe the disclosure is required by law, or otherwise necessary to comply with the law, regulatory requirements, requests from public authorities, or to enforce our agreements or policies, to protect the rights and property of our customers, the company, other businesses or the public (including for fraud prevention purposes and to prevent, investigate and prosecute criminal activities).
  • Where permitted by applicable law, we may disclose your Personal Information to our affiliates and other persons and entities for the purpose of protecting the rights, safety, security, and property of our customers, associates, and the public. We may also disclose this information to protect and enforce our rights (including for fraud prevention purposes and to prevent, investigate and prosecute criminal activities) and to assist others to do the same.
  • We may disclose Personal Information, as part of any actual or contemplated merger, sale, transfer of assets, acquisition, bankruptcy, or similar event, including related to due diligence conducted prior to such event, where permitted by law.
  • We may also disclose information about you, including Personal Information to other third parties, where we have provided specific notice to you or asked for your consent, as required by law.

Notwithstanding anything else in this notice, we may share data that has been aggregated or deidentified in such a manner that it is no longer considered Personal Information for any purpose. When we share aggregated or deidentified data, we require recipients to refrain from reidentifying the data and to pass this obligation on to downstream recipients.

Sales of Personal Information

The definition of “sale” in the CCPA includes more activities than we typically consider to be a “sale” of Personal Information. In the past 12 months, we have not sold Personal Information and do not plan to do so in the future as we understand the term “sell” based on the CCPA and its implementing regulations.

Personal Information does not include

  • Publicly available information from government records. Information that a business has a reasonable basis to believe is lawfully made available to the general public by the consumer or from widely distributed media.
  • (III) Information made available by a person to whom the consumer has disclosed the information if the consumer has not restricted the information to a specific audience.
  • (ii) “Publicly available” does not mean biometric information collected by a business about a consumer without the consumer’s knowledge.
  • Deidentified or aggregated consumer information.
  • Information excluded from the CCPA’s scope.

Cookies and other electronic technologies

  • When you use the Services, we monitor and analyze the usage of our Site and Services by collecting the information discussed above. We may also use other Internet technologies, such as Flash technologies, Web beacons or pixel tags, and other similar technologies, to deliver or communicate with cookies and track your use of our Site and Services. We also may include Web beacons in email messages, newsletters and other electronic communications to determine whether the message has been opened and for other analytics, personalization and advertising. As we adopt additional technologies, we may also gather additional information through other methods.
  • We may sometimes target ads to you through ‘onboarded’ audiences: to do this, we may disclose information you have provided to us to service providers, who will de-identify the information and associate it with cookies that enable us to reach you with display media. We may also help these service providers place their own cookies, by deploying a cookie that is associated with a ‘hashed’ value associated with interest-based or demographic data, to permit advertising to be directed to you on other websites, applications or services.
  • Most browsers automatically accept cookies, but you can modify your browser setting to decline cookies by visiting the Help portion of your browser’s toolbar. If you choose to decline cookies, please note that you may not be able to sign in, customize, or use some of the interactive features of the Services, and the advertisements you see may not be as relevant to you. Please note that limiting third-party cookies through your browser controls will not necessarily opt you out of first- or third-party interest-based advertising, as some technologies (including those we or our partners may use) may not respond to these browser controls.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights, which are subject to our records retention policies and applicable law.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose the following information to you with respect to the preceding 12 months, free of charge:

  • The categories of Personal Information we collected about you.
  • The categories of sources for the Personal Information we collected about you.
  • Our business or commercial purpose for collecting or selling that Personal Information.
  • The categories of third parties with which we share your Personal Information.
  • The categories of your Personal Information which we disclosed for a business purpose and the categories of third parties to which we shared such Personal Information.
  • The categories of your Personal Information we have “sold” and the categories of third parties to which we sold such Personal Information.
  • The specific pieces of Personal Information we collected about you (also called a “ data portability” request).

These access and data portability rights do not apply to employment-related Personal Information or B2B Personal Information, for so long as an exception under the CCPA applies to such information.

The Services are intended for general audiences, and are not directed to children under the age of 13.

How We Protect Your Personal Information

We implement and maintain reasonable security procedures and practices appropriate to the nature of the information we maintain, including appropriate technical, administrative, and physical measures designed to protect information from unauthorized or illegal access, destruction, use, modification, or disclosure. You also play an important role in protecting your Personal Information. It is your responsibility to select a strong password, change it regularly, not reuse or share your password, and alert us if you have any concerns about unauthorized use of your account.

Correction of Inaccurate Personal Information

You have the right to correct inaccurate your Personal Information . Upon our receipt of a verifiable consumer request, we shall use commercially reasonable efforts to correct the inaccuracy as you direct.

Deletion Request Rights

You have the right to request that we delete your Personal Information we collected about you, subject to certain exceptions provided by the CCPA.  Once we receive and confirm your verifiable consumer request, we will delete the requested Personal Information from our records, unless an exception provided by the CCPA applies.  For example, we may retain Personal Information as required or permitted by law, and may maintain a copy of your deletion request.

You may exercise this deletion request by: (i) contacting us by phone 916-371-1621, (ii) by fax 916-617-2821 or (iii) emailing us at banko_toiawase@nipponshokken.com. We will take reasonable steps to verify your identity before responding to a request. Certain information may be exempt from such requests under applicable law. We need certain types of information so that we can provide the Services to you. If you ask us to delete it, you may no longer be able to access or use the Services.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative. Please describe your request with sufficient detail for us to properly understand, evaluate and respond to it.

Personal Information Sales Opt-Out and Opt-In Rights

You have the right to opt out of our future “sale” of your Personal Information. To do so, you may submit a do-not-sell request by:

We do not sell the Personal Information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization from the consumer who is at least 13, but not yet 16, years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt in to Personal Information sales may opt out of future sales at any time.

Requests from Authorized Agents

If you would like an authorized agent to submit a CCPA request on your behalf or if you are an authorized agent of a consumer and registered with the Secretary of State to conduct business in California, please send us an email at banko_toiawase@nipponshokken.com for instructions and details on proof required for use of an authorized agent, including a copy of the written permission signed by the consumer for the agent to act on the consumer’s behalf in this manner.

Right of Non-Discrimination

You have a right under the CCPA not to receive discriminatory treatment by us because you exercised any of your CCPA rights.

Reasonable Access for Consumers with Disabilities

Persons with disabilities may obtain this Notice in an alternative format upon request by contacting us calling 916-371-1621.

Changes to Our Privacy Notice

We may amend this Notice at our discretion and at any time. When we make changes to this Notice, we will post the updated notice on our Site and update the notice’s effective date.  Your continued use of our Site following the posting of changes constitutes your acceptance of such changes.

Use of the Services by users from outside the United States.

The Services are hosted in the United States and locations outside the United States and are governed by United States law. If you are using the Services from outside the United States, please be aware that your Personal Information may be transferred to, stored and processed in the United States and other countries where our servers are located and our databases are operated. The data protection and other laws of the United States and other countries might not be as comprehensive or protective of certain rights as those in your country. Under United States law, your Personal Information may be subject to access requests from governments, courts, or law enforcement in the United States. By using the Services, you consent to your Personal Information being transferred to our facilities and to the facilities of those third parties to whom we disclose it as described in this Privacy Policy and processed in those facilities.
